1. The member shall be entitled to carry on his / her letterhead, visiting cards, certificates and publicity material with the annotation of NAF during the term of membership.
2. The NAF will give preference and priority in allotment of Adventure related work/ assignments within the ‘conduct parameters’ specified by the NAF and payment terms mutually agreed upon, between the NAF and the Member.
3. There are 3 kinds of Temporary Membership on term basis given online through its websites and other means.
(i) Student Membership – This is applicable upto 21 years of age.
(ii) Associate Membership – This is for 5 years. Subject to performance and contribution to the bigger issues of NAF Objectives, Associate Members can be given renewal for another 5 years or Permanent Membership.
(iii) Institutional Membership – This is applicable for 3 years.
4. The ‘Member’ on its part, undertakes to:-
(a) Ensure participation in all programs under the Banner and Flag of NAF with due care to ensure safety of participants and those conducting the programme, against undue risk and injury as also fully catering for all legal liabilities including but not limited to not only demonstrating concern for the interest and reputation of NAF but also to safeguard, promote and uphold the same in high esteem and not to do any thing which affects or compromises the image & status of the NAF.
(b) Ensure all programs are conducted, maintaining utmost quality, credibility and transparency.
(c) Fully adhere to the ‘Norms’ laid down by the NAF, from time to time, covering all aspects including information /feedback on scheduling, conduct and progress of programs allotted / conducted by NAF.
(d) In consultation with and as advised by the NAF, associate with the local NAF Chapter / Affiliate with a program to the extent feasible and acceptable to the Chapter.
5.Legally: the ‘Member’ is totally accountable in respect of abiding by the ‘Laws of the Land’ undertakes to: -
(a) Strictly and religiously adhere to the terms and conditions.
(b) Use the name, emblem, banner and flag of NAF so long as it is allowed to be used by NAF as agreed from time to time in writing.
(c) Participate in the tasks and activities relating to Adventure Sports allotted by the NAF and mutually agreed to, within the procedural, financial and other boundaries as intimated by the NAF.
(d) Not hold NAF liable or accountable for any of its acts/ activities done /performed by the members during the programme/assignment on behalf of the NAF Chapters/Affiliates, either during the ‘execution’ or during the ‘pre and post execution’ periods.
(e) Keep NAF harmless against any claim, in case of any third party brought as a consequence of and owing to any overt/covert, direct/indirect, assigned/non-assigned act and indemnify NAF to the extent of actual loss, pecuniary or otherwise, suffered by it on account of any act/activity whether done with or without knowledge of its loss causing potential.
6. General Terms:
(a) These terms and conditions contain the complete understanding of the NAF and ‘Member’. Any amendment or modification to this shall be effective only if reduced in writing and signed by both the parties.
(b) Non-Assignment: This terms and conditions may not be assigned by any party and any such attempted assignment shall be void.
(c) Governing Law & Dispute Resolution: These terms and conditions shall be governed by and under the Indian Laws. Dispute, if any, with regard to interpretation of clauses herein contained or regarding breach of terms hereof, shall first be endeavored to be resolved amicably by the parties, failing which the same shall be referred to the sole arbitrator to be appointed with the mutual consent of the parties and such reference as well as its conduct shall be governed under the provisions of the Indian Arbitration and Conciliation Act, 1996 and the venue of such arbitration shall be Delhi. The parties shall, however, be entitled to seek civil remedies simultaneously and any such civil suit/case shall be maintainable in court(s) of Delhi.
(d) Term & Termination: The terms and conditions are effective from the date of its execution specified herein and shall remain effective during the currency of the membership of NAF until it is brought to an end by or under the express act to be effected in writing by the parties in the manner stated hereinafter.
( i ) NAF may terminate the membership by serving on the Member, a notice of not less than 60 days. Any breach of terms and conditions of this terms and conditions by the ‘Member shall further entitle NAF to terminate the membership.
(ii) The member shall not cause any defect or breach or loss to NAF.
(iii ) The right to terminate, upon 60 days notice, shall also accrue to the ‘Member’, after it has completed any outstanding obligations.
( iv ) Upon expiry or earlier termination of membership, as the case may be, parties shall effect orderly discharge of their unfinished commitments existing till that point of time.
( e ) Operation of these Terms and Conditions (T&C)
( i ) These T&C contain the entire agreement between the parties about its subject matter. Any previous understanding, agreement, representation or warranty relating to that subject matter is replaced by T&C and has no further effect.
( ii ) Any right that a party may have under the MOU is in addition to, and does not replace or limit, any other right that the party may have.
( iii ) Any provision of these T&C which is unenforceable or partly unenforceable is, where possible, to be severed to the extent necessary to make this T&C enforceable, unless this would materially change the intended effect of these T&C.
( f ) Inconsistency with Other Documents. If these T&C are inconsistent with any other document or agreement between the parties, this document prevails to the extent of the inconsistency.
(g ) Authority: Both parties represent to each other that the persons signing these T & C have been duly authorized by the respective party and hence possess the requisite authority to sign these T & C.
6. Voting Rights in functioning of NAF: Student members, Associate Members and Institutional Members shall not have any voting right in the functioning of NAF.
7. Membership Fees – Fees are as follow –
(i) Student Membership – Rs 1000/-.
(ii) Associate Membership – Rs 3000/-.
(iii) Institutional Membership – Rs 7500/-.
